I have successfully acted for a Claimant and won damages in a personal injury claim after my client had inadvertently slipped on beer that had been spilt on the floor in a local bar in Gibraltar, and as a result, broke her ankle.
The bar in question would not necessarily have been automatically legally responsible for the personal injury accident caused by a customer’s spillage. However, I was able to show that the bar was responsible as it had failed in its duty of care towards her in several ways.
Firstly, the bar had failed in its duty to implement a safe system to monitor potential spillages. Secondly, it had failed to implement a system to ensure that any spillages were dealt with as promptly as reasonably possible. Thirdly, as the bar maintained that the spillage could not be quickly dealt with promptly in the particular circumstances that existed that night, I maintained that despite this the bar failed in their duty of care by not isolating the area and cordoning it off, or placing warning signs, warning of the spillage.
While I had issued proceedings in the Gibraltar Supreme Court on the Claimant’s behalf for damages for personal injury, in which I claimed that the bar was in breach of its duty to “ensure that visitors were reasonably safe for the purposes for which they were permitted to be there”, see Section 19 of Gibraltar’s Contract and Tort Act, I was successfully able to negotiate a settlement for the Claimant before the trial began in which the Claimant received a substantial award for her injury from the Bar’s insurers.
